Entity: Clock Research (“Company,” “we,” “us,” or “our”)

Platform: www.clockre.com and Siyas ERP (Collectively, the “Platform”)

This Privacy Policy explains how Clock Research collects, uses, strictly protects, and discloses information and data when you use our website and our school management software, Siyas ERP. We are committed to safeguarding the privacy of our website visitors, educational institutions, students, parents, and staff in strict accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and the Information Technology Act, 2000 of India.

1. DEFINITIONS UNDER INDIAN LAW

  • Data Fiduciary: The entity determining the purpose and means of processing personal data. For Siyas ERP, the subscribing educational institution (the “School”) is the primary Data Fiduciary.
  • Data Processor: Any person who processes personal data on behalf of a Data Fiduciary. Clock Research acts primarily as a Data Processor on behalf of the School.
  • Data Principal: The individual to whom the personal data relates (e.g., website visitors, school administrators, teachers, parents, and students).

2. INFORMATION WE COLLECT

We only collect data that is strictly necessary for providing our services.

A. Information Collected via Clock Research Website:

  • Direct Input: Name, email address, phone number, and organization name when you fill out contact forms or request a software demo.
  • Automated Collection: IP addresses, browser types, and usage metrics via cookies to analyze website performance and educational research trends.

B. Information Processed via Siyas ERP:

When a School deploys Siyas ERP (either the Cloud Version or On-Premise Version), the system processes:

  • Administrative Data: Names, contact details, and credentials of school staff and teachers.
  • Student & Parent Data: Names, enrollment details, attendance records, academic progress cards, fee payment status, and contact information.
  • Note on On-Premise Deployment: If the School uses the offline, locally installed version of Siyas ERP, all personal data is stored locally on the School’s hardware. Clock Research does not collect, transmit, or have access to this localized data.

3. HOW WE USE YOUR DATA (PURPOSE LIMITATION)

We strictly adhere to the principle of purpose limitation. We use the collected data solely to:

  • Provide, maintain, and secure the Siyas ERP platform and our website.
  • Facilitate school administrative tasks (e.g., fee management, result generation, SMS notifications).
  • Provide customer support and technical troubleshooting.
  • Comply with applicable legal obligations under Indian law.

ABSOLUTE NON-DISCLOSURE GUARANTEE: Under no circumstances does Clock Research sell, rent, lease, or monetize personal data, student records, or user profiles to third-party marketers, advertisers, or data brokers.

4. CHILDREN’S PRIVACY AND VERIFIABLE CONSENT

In strict compliance with the DPDP Act, 2023, Clock Research recognizes that Siyas ERP processes the personal data of children (individuals under 18 years of age).

  • The subscribing School, as the Data Fiduciary, bears the absolute legal responsibility to obtain verifiable parental or guardian consent before inputting any child’s personal data into Siyas ERP.
  • Clock Research processes this data entirely on the explicit instructions of the School and will not use children’s data for any tracking, behavioral monitoring, or targeted advertising.

5. DATA SHARING AND THIRD-PARTY SUBPROCESSORS

We do not share your data except in the following limited, legally sound circumstances:

  • Secure Subprocessors: We may engage secure, ISO-certified cloud hosting providers (e.g., for the online portal) to store data. These entities are bound by strict Non-Disclosure Agreements (NDAs) and legally cannot use the data for their own purposes.
  • Legal Compliance: We may disclose data if compelled by a court order, government request, or legal process originating from a competent authority within the jurisdiction of India.

6. DATA SECURITY PRACTICES

Clock Research implements “Reasonable Security Practices and Procedures” as mandated by the IT Rules, 2011.

  • We utilize industry-standard encryption, secure socket layer (SSL) technology, and rigid access controls for our cloud infrastructure.
  • Limitation of Liability: While we maintain strict security over our cloud infrastructure, the School assumes full responsibility for the security, anti-virus protection, and backup of data when utilizing the locally installed (On-Premise) version of Siyas ERP.

7. DATA RETENTION AND DELETION

  • We retain personal data only for as long as the School maintains an active subscription to Siyas ERP, or as strictly necessary to resolve disputes and comply with legal obligations.
  • Upon termination of a subscription, the School is granted a 30-day window to export its data. Following this period, Clock Research will permanently and securely destroy the data from our cloud servers, fulfilling the “Right to be Forgotten.”

8. RIGHTS OF THE DATA PRINCIPAL

Under the DPDP Act, 2023, Data Principals (Users/Parents) possess the right to:

  • Access a summary of their personal data being processed.
  • Request the correction, completion, or updating of their personal data.
  • Request the erasure of their personal data.
  • Nominate another individual to exercise their rights in the event of death or incapacity.
  • Note: For data managed within Siyas ERP, Data Principals must direct these requests to the subscribing School (the Data Fiduciary). Clock Research will promptly assist the School in fulfilling these legally mandated requests.

9. GOVERNING LAW AND JURISDICTION

This Privacy Policy shall be governed exclusively by the laws of India. Any disputes arising under this Policy shall be subject to the exclusive jurisdiction of the competent courts located in Patna and Aurangabad, Bihar.

10. GRIEVANCE REDRESSAL MECHANISM

In compliance with the Information Technology Act, 2000 and the DPDP Act, 2023, we have appointed a Grievance Officer to address any discrepancies or grievances regarding the processing of personal data.
